WRIT PETITION FOR SECURING THE RIGHTS OF THE WOMEN TO PRAY AT MOSQUES

A writ petition has been filed in the High Court Division for securing the rights of Muslim women in Bangladesh to pray at Mosque. This writ has been filed on public interest by Protection for legal & Human Rights Foundation`s Director Advocate Md Mahmudul Hasan (Mamun). The Secretary of the Ministry of Religious Affairs and the Director-General of the Islamic Foundation have been made as Respondents. In the writ petition, it is stated that according to Article 41 of the Constitution of the Peoples Republic of Bangladesh, every citizen has the right to profess, practice or propagate his/her religion. But in Bangladesh, Muslim women are facing discrimination in practicing religion. The central place of practicing Islam is “Mosque”. Islam has given equal rights to women to go and pray at the mosque. In the Hadith Book, Shahih Al Muslim it is narrated- 883: Salim narrated it from his father (`Abdullah b. Umar) that the Messenger of Allah (may peace be upon him) said: When women ask permission for going to the mosque, do not prevent them. 885: Ibn `Umar reported: `The Messenger of Allah (may peace be upon him) said: Do not prevent the maid-servants of Allah from going to the mosque. So, it is seen that both the constitution and Islam have ensured full rights to the women to perform prayers at the mosque. So, it has been stated in the writ petition to ensure the separate prayer place, separate place for ablution, and toilets at every mosque in Bangladesh.
